1. Agreement
These Terms of Service ("Terms") are a contract between you and Atlas Stories Inc. ("Atlas", "we", "us"), the operator of onatlas.world and the Atlas mobile app (the "Service"). By creating an account or using the Service you agree to these Terms, our Privacy Policy, our Community Guidelines and our Cookie Policy, which are incorporated by reference. If you do not agree, do not use the Service.
2. The Service
Atlas lets you record GPS tracks of your adventures, build stories from photos, videos, text and maps, and share them with the audience you choose. The Service is currently offered as a curated, invitation-style community in an early-access phase: features may be added, changed, limited or removed, and we do not promise that the Service will always be available or free. We will give reasonable notice of changes that materially reduce functionality.
3. Eligibility and accounts
- You must be at least 16 years old (at least 16 in the European Economic Area unless your country sets a lower age; in Quebec, at least 14 or have a parent's consent — Atlas requires 16 everywhere for simplicity). By creating an account you confirm this.
- Every new account is reviewed by our team before it is activated. We may decline or delay an account at our discretion, and we will delete a declined account's information on request.
- Give accurate information, keep it up to date, and keep your password and devices secure. You are responsible for everything done through your account. Tell us at once at [email protected] if you think it has been compromised.
- One person, one account. Do not create accounts for others, share accounts, or impersonate anyone.
- You may sign in with Google, Apple or an email address and password. Those providers' terms govern your relationship with them.
4. Your content
4.1 Ownership
You own the stories, chapters, text, photos, videos, GPS tracks and other material you post ("Your Content"). We do not claim ownership of it.
4.2 Licence to Atlas
So that we can run the Service, you grant Atlas a worldwide, non-exclusive, royalty-free, transferable and sublicensable (to our service providers only) licence to host, store, copy, back up, reproduce, resize, transcode, generate thumbnails and previews of, simplify (for GPS tracks), display, perform, distribute and otherwise use Your Content, in each case only to the extent needed to operate, secure, improve and promote the Service in accordance with the privacy setting you choose for each story. In particular:
- Content you mark Public may be shown to anyone, including people who are not signed in, on the Explore map and search, and may be featured by us on the Atlas homepage, in the app and in our own marketing materials, with your name and a link to your story. You can end this by making the story non-public or deleting it; we will stop featuring it within a reasonable time.
- Content you mark Friends or Private is shown only to the people that setting allows.
This licence ends when you delete the content or your account, except that (a) it continues for copies in backups until they expire on their normal schedule, (b) it continues for content that other users have lawfully shared or re-used within the Service before deletion (for example, a comment quoting your caption), and (c) content you added to another user's story is governed by section 4.4.
4.3 Your promises about Your Content
You confirm that you own or have the necessary rights to everything you post; that it does not infringe anyone's copyright, trademark, privacy, publicity or other rights; that it is accurate to the best of your knowledge; and that it complies with these Terms, the Community Guidelines and applicable law, including the laws of the place where a photo or track was recorded.
4.4 Collaboration, tags and comments
- A story has one owner. The owner controls its title, privacy setting, publication, collaborators and deletion. If you add chapters to someone else's story, the owner may edit, reorder, unpublish or delete them, and they are deleted when the owner deletes the story or their account. Keep your own copies of anything you care about.
- If you are tagged in a story or chapter, the tag links the content to your profile. You can ask the owner to remove it, report it, or contact us and we will remove it. (Tagged users cannot currently self-remove a tag in the app UI.)
- Comments and likes are visible to whoever can see the story. The story owner and Atlas may remove comments.
- Members of a shared media folder can view, and if given the role, add or remove media in that folder. Folder owners control membership.
4.5 Feedback
If you send us ideas or feedback, we may use them without obligation to you.
5. Location, GPS and outdoor safety
- GPS recording, routes and maps are provided for storytelling and personal record-keeping. Atlas is not a navigation, safety, emergency or rescue tool. Do not rely on it to find your way, to judge whether a route is safe or legal, or to summon help.
- GPS data can be inaccurate, incomplete or interrupted (phone settings, terrain, battery, signal). Generated routes — including boat and plane routes, which are drawn as simple arcs — are illustrations of an intended line, not a navigable or checked path.
- Background recording uses significant battery. You are responsible for your own preparation, equipment, permits, park and trail rules, private-property rules and personal safety.
- Be careful what location you reveal: do not post precise locations of your home or other private places, of other people, or of sensitive wildlife, cultural or archaeological sites. See the Community Guidelines.
6. Third-party services
- Google Maps. Maps, place search and routes are provided by Google Maps Platform. By using them you agree to be bound by the Google Maps/Google Earth Additional Terms of Service and acknowledge the Google Privacy Policy.
- Strava. Connecting Strava is optional and subject to Strava's terms. We import only activities you select and show your Strava data only to you unless you place it in a story. You can disconnect at any time; when you do, you choose whether imported tracks are kept or deleted. We are not responsible for Strava's availability or for changes Strava makes to its API.
- App stores. If you downloaded the app from the Apple App Store or Google Play, the store's terms also apply. Apple and Google are not party to these Terms and have no obligation to provide support or maintenance for the app, but they and their subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. To the extent required by Apple, the licence to the iOS app is limited to a non-transferable licence to use the app on Apple-branded devices you own or control, and Apple's minimum EULA terms apply.
7. Acceptable use
The Community Guidelines set out what may and may not be posted, and are part of these Terms. In addition, you agree not to:
- access the Service by any means other than the app, the website and any API we publicly document; scrape, crawl or bulk-download content or user data; or circumvent rate limits, privacy settings or access controls;
- probe, scan or test the Service for vulnerabilities except under the responsible-disclosure process on our Security page;
- upload malware, or use the Service to send spam, phishing or unsolicited messages;
- use the Service to track, locate or monitor another person without their consent;
- copy, modify, reverse engineer or create derivative works of the Service or its software except as permitted by law;
- use another user's content outside the Service without their permission and, where required, credit;
- use the Service for any commercial purpose without our written agreement, or in violation of any law.
8. Moderation, enforcement and appeals
We may review content and accounts, remove or restrict content, and warn, suspend or terminate accounts that violate these Terms or the Community Guidelines, following the enforcement ladder and appeal process described there. We may also preserve and disclose information where the law requires it or to protect users and the public. We are not obliged to monitor content, and we are not responsible for content other users post.
8.1 Copyright complaints
We respect intellectual-property rights. If you believe content on Atlas infringes your copyright, send a notice to [email protected] with: your contact details; identification of the copyrighted work; the URL of the allegedly infringing content; a statement that you have a good-faith belief the use is not authorized; a statement, under penalty of perjury where applicable, that the notice is accurate and you are the owner or authorized to act; and your signature. We process notices under Canada's notice-and-notice regime and, for US claimants, the DMCA, and we terminate the accounts of repeat infringers. If your content was removed and you believe that was a mistake, you may send a counter-notice to the same address.
9. Deactivation, deletion and termination
- Deactivation. You can deactivate your account in Settings → Privacy & Security. Your profile and content are hidden from others until you sign in again, which reactivates the account.
- Deletion. You can permanently delete your account in Settings → Account → Delete account, or by following these instructions. Deletion removes your profile, content, media, tracks and social connections immediately and cannot be undone; backups expire on their normal schedule. Chapters you added to other users' stories, and comments and likes you left, are deleted with your account. If you signed in with Apple we revoke your Apple token as part of deletion.
- By us. We may suspend or terminate your account for violating these Terms or the Guidelines, if required by law, or if we discontinue the Service (with reasonable notice where practical). Sections 4.2 (to the extent stated), 4.5, 10, 11, 12 and 14 survive termination.
- Export first. Deletion is irreversible; request an export of your data from Settings before deleting if you want a copy.
10. Atlas's intellectual property
The Service, including its software, design, maps styling, logos and text (but not Your Content or third-party content), belongs to Atlas or its licensors and is protected by copyright and other laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the app and website as permitted by these Terms. The Atlas name and logo may not be used without our written permission.
11. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy of location or map data, and uninterrupted or error-free operation. We do not endorse and are not responsible for content posted by users or for third-party services. Nothing in these Terms limits warranties or rights that cannot be limited under the laws of your place of residence, including under Quebec's Consumer Protection Act and consumer laws of the EEA and United Kingdom.
12. Limitation of liability
To the fullest extent permitted by law, Atlas and its directors, employees and contractors will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of data, profits, goodwill or opportunity, or for personal injury or property damage arising from outdoor activities you undertake, arising out of or related to the Service, even if advised of the possibility. Our total liability for all claims relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim and CAD $100. These limits do not apply to liability for death or personal injury caused by our negligence, for fraud, for gross negligence or wilful misconduct, or to any liability that cannot be limited by applicable law, including for consumers in Quebec, the EEA and the United Kingdom.
13. Indemnity
You agree to defend and indemnify Atlas against claims, damages and reasonable costs (including legal fees) arising from Your Content, your use of the Service, or your breach of these Terms or of any law or third-party right. This section does not apply to consumers where prohibited by local law.
14. Governing law and disputes
These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable there, without regard to conflict-of-law rules. Any dispute will be brought in the courts of Montréal, Quebec, and you consent to their jurisdiction — except that if you are a consumer, you keep the protection of the mandatory laws and courts of the place where you live, including Quebec consumers' right to bring proceedings in Quebec and EEA/UK consumers' rights under their local law. Before going to court, please email us; most problems can be solved informally, and we commit to trying for 30 days.
15. Changes to these Terms
We may update these Terms. For material changes we will give at least 30 days' notice by email and/or in the app before they take effect, and where the law requires it we will ask you to accept the new Terms before continuing. Other changes take effect when posted with an updated date. If you do not agree to a change you may stop using the Service and delete your account. The current and prior versions are available on request.
16. General
- These Terms, with the documents they incorporate, are the entire agreement between you and Atlas about the Service.
- If any part is found unenforceable, the rest remains in effect.
- We may assign these Terms as part of a merger, acquisition or sale of assets; you may not assign them.
- Our failure to enforce a provision is not a waiver.
- Notices to you may be sent to your account email or shown in the app. Notices to us go to [email protected] or the postal address in the Privacy Policy.
- The parties have requested that these Terms and related documents be drawn up in English. Les parties ont exigé que la présente convention et tous les documents connexes soient rédigés en anglais. A French version may be provided on request; we intend to publish an official French version for Quebec users.
